SYDNEY, N.S. — The province's independent Serious Incident Response Team (SiRT) has cleared a Cape Breton Regional Police officer of an allegation of assault.
A complaint was filed against the officer after an incident on Ferry Street in Sydney on July 23, 2019.
Officers responded to a call of an intoxicated male in the area of Ferry Street and while on scene, officers were confronted by another intoxicated man who was deemed to be obstructing officers.
Additional officers were called to assist and the man was arrested and placed in a police vehicle where he kicked out the rear side window and then violently striking his head several times against the plexiglass divider. He was treated in hospital and released.
The man claimed his injuries were the result of officers using excessive force by slamming his head into the ground.
The investigation determined the injuries were consistent with striking a man-made object such as a plexiglass divider with metal edges.
Based on these findings, no charges will be laid against the officer.

SIRT is responsible for investigating all serious incidents involving police in Nova Scotia. Investigations are under the direction and control of the independent civilian director who has the sole authority to determine if charges should be laid after the conclusion of an investigation.
