Pepper spray case adjourned to Monday
AMHERST – Michael Douglas Smith, 18, of Spring Street, Amherst, was in court on Monday to face four charges and had his case adjourned to make a plea to June 11, at 1:30 p.m.
Smith faces four charges in all - two counts of robbery, one count of using pepper spray to committing an offense, and one count of assault with a weapon.
Smith is charged with robbery for allegedly stealing an HP laptop computer and a Playstation 2 while armed with an offensive weapon – pepper spray.
He is charged with allegedly using violence to steal the laptop and the Playstation 2.
Smith is also charged with allegedly having in his possession a weapon – pepper spray, for the purpose of committing and offense, and he is charged with assault with a weapon for allegedly committing an assault on the person who’s home he robbed by using a weapon – pepper spray.
Smith is one of three individuals arrested in alleged home invasion, which occurred April 9, in Amherst.
Two other individuals were charged in the case. They are less than 18-years-old and, therefore, their names cannot be published under the Youth Criminal Justice Act.
