AMHERST - The man who entered a guilty plea to stealing women's underwear in April has yet to be sentenced.

Harvey Joseph Venus appeared for sentencing in provincial court on Tuesday to find out it was being set over.

"There was a problem with the filing," said Mary Ellen Nurse, Crown attorney, regarding to contacting the victim of the incident.

"The sergeant in the case contacted the victim (Monday) night and (Tuesday) morning about submitting a victim impact statement.

Nurse said the victim is still interested in making a statement so requested an adjournment for that purpose.

Defence attorney Maurice Bastarache didn't have a problem with the adjournment.

During Venus' appearance, a charge of failing to comply with a recognizance - one of abstaining from communication with anyone with a criminal record - was withdrawn.

Venus will return for sentencing on the theft and one count of failing to comply with a recognizance for failing to keep the peace and be of good behaviour on July 14 at 9:30 a.m.
