AMHERST - The man arrested for stealing women's underwear is scheduled to appear in court Monday morning.

Harvey Joseph Venus was arrested in Moncton on Thursday after eyewitnesses identified him as the man trying to steal the underwear from a North Adelaide Street residence last Saturday.

Amherst Police Department's Sgt. David Lepper said while Venus's DNA is in the database from a sexual assault conviction back in 2005, it wasn't the DNA that lead police to request a warrant for Venus's arrest but the eyewitnesses.

Venus was sentenced in June of 2005 to five years in custody following a break and enter and sexual assault on a 14-year-old girl.

He's facing three charges from last weekend's incident - one of theft under $5,000 and two of breaching a recognizance.
