U.K. foundation appeals awarding of $100m worth of art to Fredericton gallery

SAINT JOHN, N.B. - The Beaverbrook U.K. Foundation has appealed the awarding of $100 million worth of artworks to the Beaverbrook Art Gallery in Fredericton.
In a document filed this week in Court of Queen's Bench in Saint John, the foundation is demanding the return of the art and the awarding of millions of dollars in legal costs.
Lawyers for the foundation claim an appellate panel erred last month when it refused to overturn an arbitrator's decision that gave the lion's share of disputed works to the Fredericton gallery.
The notice of appeal, which will be heard in Saint John on Dec. 15, asks for the outcome to be reversed because the three-judge panel incorrectly interrupted a point of law called fraudulent concealment.
The gallery claims that its founder, Lord Beaverbrook, donated the art while the foundation insists it was only loaned.
The case, which has wound its way through legal channels for five years, appeared to have finally been resolved when the foundation's appeal was rejected on Sept. 8.
