P.E.I man gets two years for aggravated assault on 10-month-old boy

SUMMERSIDE, P.E.I. - A Kensington, P.E.I., man who shook a 10-week-old infant in his care, breaking the boy's leg, fracturing his spine and causing permanent brain injury, was sentenced today to two years less a day.
David Evans Kelly, 25, was earlier found guilty of aggravated assault.
He had been caring for the baby on Jan. 22, 2009, when he became frustrated after the baby would not settle down.
Court was told Kelly picked up the baby and shook him three times before putting the boy back in his swing.
Within minutes, the baby was pale and unconscious.
Kelly has also been placed on probation for three years and must undergo mental health assessment, counselling and treatment.
